DUTRES is a listings and discovery platform that allows students ("Users") to post products or services for sale ("Listings") and communicate with one another about those Listings through in-app messaging.

DUTRES is a marketplace and communication tool only. DUTRES does not process, hold, transmit, or handle payments of any kind. All payment, pricing negotiation, and exchange of money between a Buyer and a Seller happens entirely outside the Platform and is the sole responsibility of the Users involved. DUTRES has no visibility into, involvement in, or control over how or whether a transaction is completed, and does not act as a payment processor, escrow agent, or financial intermediary in any capacity.

• You must be a current student (or otherwise meet any eligibility criteria we specify, such as holding a valid campus/institutional email address) to create an account.
• You must be able to form a legally binding contract in your jurisdiction to use the Platform. If you are a minor in your jurisdiction, you may only use the Platform with the involvement and consent of a parent or legal guardian, to the extent required by applicable law.
• You are responsible for ensuring the information you provide during sign-up, including your email address and campus affiliation, is accurate.

• Each User has a single account that may operate as a Buyer, a Seller, or Both, and may switch between these roles at any time.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to notify us promptly if you suspect unauthorized use of your account.

• Sellers may create Listings for products or services they genuinely intend to sell or provide.
• Sellers are solely responsible for the accuracy of their Listings, including descriptions, pricing, images, and availability.
• DUTRES does not verify, inspect, endorse, or guarantee the quality, safety, legality, or authenticity of any Listing, product, or service posted on the Platform.
• Prohibited Listings include, without limitation: illegal goods or services; counterfeit items; stolen property; weapons; drugs or controlled substances; academic dishonesty services (e.g., paying someone to complete assignments or exams on a student's behalf, where prohibited by the student's institution); adult content or services; and anything that violates applicable law or the policies of your educational institution.
• We reserve the right to remove any Listing, at our discretion, that we believe violates these Terms or is otherwise inappropriate for the Platform, without prior notice.

To be unambiguous:

• DUTRES does not provide, integrate with, or facilitate any payment gateway, checkout process, escrow service, or financial transaction mechanism.
• Any agreement to buy or sell a product or service, and any exchange of money or other consideration, is a private arrangement made directly between the Buyer and Seller, entirely independent of DUTRES.
• DUTRES is not a party to any transaction between Users and bears no responsibility for payment disputes, non-payment, non-delivery, defective goods, misrepresented services, refunds, or any other issue arising from a transaction arranged through the Platform.
• Users are strongly encouraged to exercise their own judgment and take reasonable precautions, such as meeting in safe, public locations and verifying goods or services before exchanging payment, when completing transactions arranged via DUTRES.

• The Platform provides messaging so Buyers and Sellers can communicate about specific Listings.
• You agree not to use messaging to harass, threaten, defraud, spam, or otherwise abuse other Users.
• We reserve the right to review reported messages for the purpose of investigating violations of these Terms, and to suspend or terminate accounts that misuse the messaging feature.
• Do not use in-app messaging to arrange or discuss anything unlawful or prohibited under Section 4.

• After a transaction is marked complete, Buyers may leave a rating and review of the Seller.
• Reviews must reflect a genuine transaction experience and must not contain false, defamatory, harassing, or unlawful content.
• We reserve the right to remove reviews that violate this section.

You agree not to:

• Impersonate another person or misrepresent your affiliation with any institution.
• Post false, misleading, or fraudulent Listings.
• Use the Platform for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to interfere with, disrupt, or gain unauthorized access to the Platform, its servers, or other Users' accounts.
• Scrape, harvest, or collect data from the Platform without our prior written consent.

• Users may report Listings, messages, or other Users that they believe violate these Terms.
• We reserve the right, but have no obligation, to investigate reports and to remove content, suspend, or terminate accounts at our sole discretion.

• The Platform is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
• DUTRES does not guarantee that the Platform will be uninterrupted, secure, or error-free.
• DUTRES makes no representations or warranties about the conduct of Users, the quality or legality of any product or service listed, or the outcome of any transaction arranged through the Platform.

To the maximum extent permitted by applicable law, DUTRES and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or related to:

• Your use of or inability to use the Platform;
• Any transaction, dispute, or interaction between Users, including any failure to pay, deliver, or perform;
• Any Listing, product, or service obtained through the Platform;
• Unauthorized access to or alteration of your data.

Because DUTRES does not handle payments, DUTRES is not liable for any financial loss arising from a transaction between Users, including non-payment, fraud, or disputes over goods or services rendered.

You agree to indemnify and hold harmless DUTRES, its operators, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Platform, your Listings, your interactions with other Users, or your violation of these Terms.

• You retain ownership of content you post, including Listing text and images, but grant DUTRES a non-exclusive, royalty-free, worldwide license to host, display, and distribute that content as necessary to operate the Platform.
• The DUTRES name, logo, and platform design are the property of DUTRES and may not be used without permission.

We may suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to the Platform or other Users. You may stop using the Platform and delete your account at any time.

We may update these Terms from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms. We will make reasonable efforts to notify Users of material changes.

These Terms shall be governed by the laws of the Republic of South Africa, without regard to its conflict of law principles.
